Attorney General Forced Into Hot Seat

Consider the unmitigated gall of Sen. Madaleno (D) Mont. Co. to put Atty. Gen. Gansler in a position to rule against standing Maryland law which clearly defines marriage in Maryland as a union of one man and one woman. Yes we also contend with the “Full faith and credit” clause of our constitution, but if other states are not honoring the California ruling, in whose laws do we place our full faith and credit? Mr. Gansler is truly in a tight spot. He testified before the Senate Judicial Proceedings Committee in favor of some of the homosexual legislation proposed in the most recent General Assembly session.
The homosexual agenda has not used the conventional means of getting their laws passed. Most of us go through the legislative process and allow our elected officials to come to consensus and make law with accountability. The homosexual agenda moves the judicial branch hoping for one activist judge after another to do their heavy lifting. This is for a reason, and it benefits two groups. First it benefits the homosexual advocates in that they do not need the support of an elected body, they just need one activist judge to agree with them. The second group is the elected ones themselves. Knowing that this issue is not popular amongst the citizens of Maryland, they can sit back and watch these activist judges do their dirty work and their fingerprints are not at the crime scene.
Sen. Madaleno’s request for an opinion from the Attorney General is just the opening bid in the 2010 General Assembly Session. If Mr. Gansler rules in favor of honoring California’s same sex marriages in Maryland, there will be a referendum in 2010. Unfortunately, as referendums go in Maryland, they are not easy. Organizing, motivating, publicizing, and the physical task of gathering valid signatures is a daunting task. Once complete, the process of separating valid and non-valid signatures begins and that is usually where the wheels fall off the cart.
You might remember the most recent signature drive against speed cameras. The effort fell 1,600 signatures short of the needed 53,000. Gathering 53,000 signatures is not sufficient. In order to end up with 53,000 valid signatures, a group needs to gather in the neighborhood of 75,000 to be safe. This is no small effort. It can be done, but only if the group is organized and volunteers ready to be mobilized.
